I would expect that a jury of tribal leaders would know how to apply  
the appropriate legal precedents to someone who kidnapped members of  
their community.  Perhaps they would wind up serving as indentured  
servants to the wronged parties for a year or two.  Let's see, a  
fifty or sixty innocent shepherds in the whole group, at two years  
service each ( against the five or six years lost) would be a life  
sentence in Afghanistan for each of them.
Not bad, considering that for some time, kidnapping was a capital  
offense in this country.
